Terms of Service

Effective date: September 6, 2026

These Terms of Service ("Terms") are an agreement between you and Rescape Inc., doing business as FillMyForms ("FillMyForms," "we," "us," or "our"). They govern our website, web and mobile applications, hosted Model Context Protocol (MCP) service, and related form-processing, signing, upload, and sharing features that we make available (collectively, the "Services").

By selecting an agreement checkbox or taking another action clearly identified as acceptance, you agree to these Terms. If you do not agree, do not use the Services. Our Privacy Policy explains our handling of personal information.

Section 14 contains a binding individual arbitration agreement and a class-action waiver. Unless you opt out as described there, disputes with FillMyForms will be resolved by individual arbitration rather than in court.

1. Eligibility, authority, and accounts

You must be at least 18 years old, or the age of majority where you live if higher. Minors may not use the Services themselves. An eligible adult may complete forms for a child or another person only with lawful authority.

If you use the Services on behalf of a business or other organization, you represent that you can bind that organization, and "you" includes that organization. You must provide accurate account information, protect your devices and credentials, and promptly notify us of suspected unauthorized access. You are responsible for all activity under your account, whether or not you authorized it, including activity by people and applications you allow to use your account or your credentials.

2. A form-processing tool, not a review service

The Services help digitize, extract information from, fill, sign, and share forms. Features may differ by platform or plan. Descriptions of planned features are not commitments to deliver them.

Automated processing can make mistakes, omit information, or place information incorrectly. You must review the document and its contents before relying on, signing, or submitting it. Check that saved information is still accurate and appropriate for the particular form. You are solely responsible for the accuracy and completeness of what you submit and for the consequences of submitting an unreviewed form.

We do not provide human validation, correction, professional review, or legal, medical, tax, financial, or other professional advice. We do not guarantee accuracy, completeness, eligibility for any benefit, satisfaction of filing requirements, or acceptance by a recipient. You are responsible for determining the applicable requirements and meeting deadlines. Do not rely on the Services for emergency or time-critical decisions without independent safeguards.

3. Your content and permissions

"Your Content" includes documents, images, form responses, signatures, and other information you provide or authorize us to process. You retain whatever rights you have in Your Content. We do not claim ownership of your completed forms merely because we process them.

You represent that you have the rights, permissions, and lawful authority necessary to upload, process, modify, sign, and share Your Content as instructed, including authority concerning other people's information. You must not submit content in violation of law or another person's rights.

You grant us a nonexclusive, worldwide, royalty-free permission to host, copy, process, modify, format, display, and transmit Your Content, and to allow our service providers to do so, only as needed to provide, secure, and maintain the Services, carry out your instructions, and meet applicable legal requirements. Retention and any permitted use of anonymized form structure are governed by the Privacy Policy. This permission does not authorize additional model-training, advertising, sale, or public-publication uses of personal information beyond those permitted by the Privacy Policy and applicable law.

4. Sharing, upload links, and form requests

When you use your device's Share function, you choose the destination application or recipient. That destination may have separate terms and privacy practices. We cannot retrieve copies already transferred outside our control.

A person or organization may send you a link to upload a document or complete a form (the "Requester"). By completing the submission action identified in that workflow, you instruct us to deliver the submitted documents, responses, and included signatures to the identified Requester. Review the recipient and what will be submitted before proceeding. A forwarded link may still return information to its original Requester, not the person who forwarded it.

Requesters must accurately identify themselves, collect only information they are authorized to collect, provide required notices, obtain necessary permissions, and lawfully use and protect responses. A request does not mean FillMyForms endorses or verifies the Requester. If you are a Requester, you are responsible for the forms and links you send, for how you use the responses, and for any claim by a person who submits information to you.

Protect sharing links: access may depend on possession of the link unless additional controls are provided. Deleting your copy or account does not itself undo a completed transmission or delete a recipient's independently retained copies, subject to applicable law. Submitting a form does not authorize access to unrelated saved information or other documents in your account.

We do not guarantee successful delivery, receipt, acceptance, or action by a recipient. Where confirmation matters, obtain it independently.

5. Signatures and acknowledgments

When you draw, type, or upload a signature and complete the accompanying acknowledgment, you instruct us to apply that signature to the document identified in the signing flow. You represent that you are signing voluntarily, have reviewed the document, and are signing for yourself or in a representative capacity you are legally authorized to use. You must not forge a signature or impersonate another person.

Saving or providing a signature is not blanket authorization to sign other documents. Connecting an agent or accepting these Terms does not itself authorize signing a particular document.

We do not guarantee a signature's legal validity, enforceability, admissibility, or compliance with the E-SIGN Act, UETA, or any particular signing requirement. Unless expressly agreed in a separate written agreement, these limitations apply to both free and paid Services. We do not provide notarization, witnessing, or independent identity verification. Recorded timestamps or acknowledgment information do not create such a guarantee. You are responsible for confirming the required signing process and keeping needed copies.

6. MCP and authorized automation

Our hosted MCP service is part of the Services. You may use authorized clients and agents within applicable access controls, documentation, and usage limits. Protect access tokens and configure permissions carefully.

Requests from a client or agent you connect are your instructions, and we may act on them without further confirmation. You are responsible for those requests and their results even if the client or agent acted differently than you intended, including because of misconfiguration, a compromised token, or instructions it took from content it processed. You are responsible for reviewing resulting forms. Automation does not remove the review, signature, or sharing requirements above.

Any independently operated assistant, client, or destination that you choose may handle information under its own terms. This distinction does not exclude our responsibilities for providers we engage to deliver the Services.

7. Privacy, cloud processing, and restricted healthcare use

We use cloud hosting, storage, and processing providers, including for some image and document processing. Using a mobile application does not mean processing occurs only on your device. Our handling of information, including retention and deletion, is described in the Privacy Policy. Nothing in these Terms gives us permission to disregard that policy or applicable privacy and security law.

The Services are not a records-archiving service. Keep your own copies of important documents. We do not promise permanent storage or recovery of deleted or expired information.

These Terms are not a Business Associate Agreement (BAA). A paid subscription, account registration, upload, or signature does not constitute a BAA or approval for regulated healthcare use.

You must not use the standard Services to create, receive, maintain, or transmit protected health information on behalf of a HIPAA-covered entity or business associate unless we have first approved that use in writing, you have the applicable paid service arrangement, and we have executed a separate BAA covering the specific Services and configuration. You represent that your use complies with this restriction.

This restriction does not prohibit individuals from completing their own personal forms containing health information, or an authorized adult from helping another individual in a personal capacity. It does not waive or determine any party's obligations or status under applicable law.

8. Free and paid Services

We may offer free access and paid plans, including individually agreed fixed-fee plans with document or usage limits. Free access does not automatically become paid access.

The offer you accept at checkout or in a written order ("Order") will specify the fee, applicable taxes, plan duration, included usage, how usage is counted, and any renewal terms. Payment is due as stated in the Order. Customer purchase-order terms do not modify these Terms unless we expressly agree in writing.

When you reach a limit, we may pause additional processing or require an upgrade. We will not charge overage fees without your prior agreement. Unused periodic allowances do not roll over unless the Order says otherwise. Any expiration of a one-time allowance must be disclosed before purchase and permitted by applicable law and store requirements.

A plan renews automatically only if automatic renewal is clearly disclosed and you affirmatively agree. You may stop future renewals using the cancellation method provided at purchase or in your account. Cancellation ordinarily leaves access available through the paid period. Uninstalling an app does not itself cancel a subscription managed by an app store.

Fees are nonrefundable except as required by law, applicable app-store rules, an express refund policy or Order, or these Terms. We will correct billing errors and refund amounts charged for Services we do not deliver. Mere nonuse does not entitle you to a refund.

Price or allowance changes apply prospectively, with advance notice and any required consent. They will not reduce an already purchased allowance during its agreed term. If we discontinue a paid Service or terminate your paid access for reasons other than your material breach, we will refund the unused prepaid portion.

9. Permitted use and our intellectual property

Subject to these Terms, we grant you a limited, nonexclusive, nontransferable right to use the Services for lawful personal or internal business purposes. Unless a separate application license governs, this includes using our mobile software on devices you own or control, subject to applicable store usage rules. We retain rights in our software, models, interfaces, branding, and technology.

You must not use the Services for fraud, forged signatures, impersonation, unlawful collection or disclosure of information, harassment, infringement, or malicious code. You must not access another person's records without authorization, bypass access or usage controls, disrupt the Services, resell access without permission, or reverse engineer our software except where applicable law permits. Authorized MCP use is allowed; it is not prohibited merely because it is automated. Applicable open-source licenses remain controlling for their components.

We may restrict or remove unlawful content or access. Our policy is to terminate repeat infringers in appropriate circumstances. Report suspected infringement or abuse using the contact information below; do not include unnecessary sensitive information. Copyright complaints should include the information required by 17 U.S.C. § 512(c)(3) and be sent to inquiries@fillmyforms.com or the mailing address below, attention Copyright Agent.

10. Availability, changes, and termination

We may maintain, modify, limit, or discontinue features, subject to purchased commitments and applicable law. We do not promise uninterrupted availability, a service-level agreement, or continued support for every device, format, or integration.

We may suspend or terminate access for a material breach, nonpayment, unlawful use, security risk, or legal requirement. Where practicable, we will provide notice and an opportunity to address the issue; urgent circumstances may require immediate action.

For planned discontinuation or ordinary account closure initiated by us, we will provide reasonable advance notice and an opportunity to export information still available under our retention policies where practicable. This does not extend expired retention periods.

You may stop using the Services at any time. Account or data deletion is handled under the Privacy Policy and applicable law. Accrued payment obligations and provisions that by their nature should survive termination remain effective.

11. Warranty disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available." Except for obligations we expressly undertake, we disclaim warranties of merchantability, fitness for a particular purpose, and noninfringement, and warranties arising from a course of dealing or usage of trade.

We do not warrant that the Services will be error-free, uninterrupted, compatible with every system, or completely secure. These disclaimers do not override express commitments in the Privacy Policy or a signed agreement, or rights that cannot lawfully be excluded.

12. Limitation of liability

To the fullest extent permitted by law, FillMyForms and its officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Services, including lost profits, lost business opportunities, or consequential losses from inaccurate, lost, misdirected, or delayed documents.

The combined total liability of those parties arising out of or relating to the Services or these Terms will not exceed the greater of US $100 or the amount you paid for the Services during the 12 months before the event first giving rise to the claim. Payments made through an app store count toward this amount. Multiple claims do not increase this cap.

Subject to the exceptions below, this cap applies to claims involving processing errors, signatures, delivery failures, data loss, unauthorized access or disclosure, and other use of the Services, whether based on contract, tort (including ordinary negligence), or another legal theory, even if the possibility of loss was disclosed.

These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, or liability or remedies that applicable law does not permit us to exclude or limit. They allocate financial liability; they do not authorize conduct inconsistent with our Privacy Policy or excuse legal privacy or security duties.

13. Indemnity

You will defend and indemnify FillMyForms and its personnel against third-party claims, damages, and reasonable legal expenses to the extent caused by your unlawful use of the Services, content you lacked authority to provide, forged or unauthorized signatures or submissions, unlawful collection or disclosure through the Services, or requests made through a client or agent you connected. If you use the Services for a business or other organization, that organization shares this obligation.

This obligation does not apply to the extent a claim results from our breach of these Terms, negligence, or misconduct. We will give reasonably prompt notice and reasonable cooperation. A settlement imposing an admission or nonmonetary obligation on us requires our consent, not to be unreasonably withheld.

14. Governing law and disputes

Delaware law and the Federal Arbitration Act govern these Terms, except where applicable law requires otherwise.

Any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, or its Commercial Arbitration Rules for business users, rather than in court. Either party may instead bring an individual claim in small-claims court or seek court relief to protect intellectual property or stop unauthorized use of the Services. Claims may be brought only on an individual basis, not in any class, consolidated, or representative proceeding. If this class-action waiver is found unenforceable for a claim, that claim will be heard in court and the rest of this section still applies.

You may opt out of arbitration by emailing inquiries@fillmyforms.com within 30 days after first accepting these Terms. Claims not subject to arbitration will be brought in the state or federal courts located in Delaware, and the parties consent to their jurisdiction, subject to mandatory consumer protections.

15. Updates and general terms

We may update these Terms prospectively. We will provide at least 30 days' notice of materially adverse changes, except where a shorter period is reasonably necessary for legal, security, or abuse-prevention reasons. We will obtain renewed acceptance where required. Where permitted by law, continued use of the Services after an updated version takes effect is acceptance of it. Changes do not retroactively expand our rights over previously collected personal information.

We may provide notices through the Services or your account email, subject to any legally required method. Keep your contact information current.

These Terms and any applicable Order govern your use of the Services. A separately signed agreement controls conflicting provisions for the subject matter it expressly covers; a BAA controls only its covered healthcare Services. The Privacy Policy governs personal-information practices and is not overridden by a broader interpretation of these Terms.

If a provision is unenforceable, the remainder remains effective. A delay in enforcement is not a waiver. You may not transfer this agreement without our consent. We may transfer it to a successor in a merger, reorganization, or sale of the relevant business, together with its obligations and subject to applicable privacy law. No agency, partnership, or employment relationship is created. The parties protected by Section 12 may enforce that section; otherwise, there are no intended third-party beneficiaries except under an applicable app license.

16. Mobile app stores and contact

Your use of a mobile application may also be governed by the distributing store's terms and an applicable end-user license agreement. For an application obtained through Apple's App Store, Apple's Standard End User License Agreement applies unless we supply a custom license. The applicable application license controls conflicting provisions about the software license; these Terms govern our Services. Applicable store purchasing, cancellation, and refund requirements are not overridden by these Terms.
